The privacy of your data is a big deal to us. We consider this data to be yours and not ours. In this policy, we lay out:

This policy applies to all products built and maintained by TallyGo Trouve, LLC ("TallyGo", "We", "Us", "Our") including but not limited to the TallyGo mobile application (the "TallyGo app"), tallygo.com (the "Site), tallygoportal.com (the "Web app"), TallyGo bluetooth device (the "TallyGo Tracker"). These are collectively referred to as "Services".

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

Device information

  • Examples of Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
  • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: shared with our processor Shopify.

Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers or PayPal account), email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify.

Customer support information

  • Examples of Personal Information collected: name, email address, phone number, and mailing address.

Account creation for the use of our Services

To register for our Services whether through the Mobile app or through the Web app, you will need to provide an email address and password. This is necessary to establish ownership to any TallyGo Tracker you choose to activate. This also allows us to send notifications about the status of your lost item and provide support.

To assist in account creation you may opt to use an existing social network account or 3rd party account, such as Facebook, Google, or Apple. This removes the anxiety of having to compose a new password. With your consent we obtain your email address and token (not your password) from the social network. This token is a promise from the social network or 3rd party that you are who you say you are.

You may choose to provide additional contact information on the Web app such as first name, last name, street address, phone, etc... This information remains private and not shared with any third parties without your prior consent.

Information from your use of our Services

TallyGo Tracker ID, Title, and Picture

When you activate a TallyGo Tracker, the TallyGo Tracker ID will be associated with your account. In addition, you may choose to provide a custom title and or picture. This will also be associated with your account. This information remains private and not shared with any third parties without your prior consent.

Location Information

As an asset tracking service, it is necessary for the TallyGo app to collect information about the location of your TallyGo Trackers. This allows us to display on your map last seen location and time. By default this information is periodically uploaded to Our servers while the app is running in the foreground or background. However you may choose to keep this information local to your mobile handset. This in effect makes you invisible to Our servers. Note that not reporting tracker location does limit the functionality of some of the Services We provide. For instance the TallyGo Consumer Dashboard would be severely limited or the Sharing Services We provide would also be limited. Further you will not participate in the Community Find Service that helps other users locate their lost items. What you choose to do is totally up to you. Again, this is your data, not ours. To turn OFF location reporting to Our servers, from the TallyGo App go to PreferencesBeacon Location Data and turn the Send Beacon Location To Cloud switch to the OFF position.

With respect to the aforementioned Community Find Service. We may collect location information if you come into bluetooth range of a TallyGo Tracker that does not belong to you and that may or may not be flagged as lost. The location information is reported anonymously to the owner of the TallyGo Tracker and does not disclose any identifying information about the finder and vice versa. Of course the same is true for other users that come into bluetooth range of your TallyGo Tracker.

Location information is never shared with other users unless you specifically choose to do so using the Service we provide for sharing.

Customizations and configurations

Any activation, configuration, or customization changes you make to your TallyGo Tracker will be recorded on our database. As an asset tracking system, you may have dozens if not hundreds of assets in your inventory. If these changes were not logged on our database, then all would be lost should your handset fall victim to some catastrophic end, such as being dropped or getting immersed in water. Restoring could take hours if not days. Since this information is stored securely on our private database, a simple login restores all. This information remains private and not shared with any third parties without your prior consent.

Voluntary correspondence

When you write TallyGo with a question or ask for help, we keep that correspondence, including the email address, so that we have a history of past correspondences to reference if you reach out in the future. This information remains private and not shared with any third parties without your prior consent.

Minors

These Services intended for individuals under the age of 13. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.
  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent;
  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

Data Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

Controlling your personal information

We will retain your information as long as you have not deleted your account and for any record keeping and tax obligations imposed by applicable law.

You may delete your account from the TallyGo App by going to Preferences → Account Management in both the Android and iOS App.

You may also request the deletion of your account and personal information by email (contact information found in Contact section below). Please note that it is possible for some information to be retained in our back-up systems.

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

    GDPR

    If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.     Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.     A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance whether it’s their first time visiting or if they are a frequent visitor.
